Terms & Conditions

    1. At the time of proposal, ROUNDBOX PRODUCTION will ONLY provide the customer with a written estimate or quotation by email. These Terms and Conditions can be read at any time on the ROUNDBOX PRODUCTION website.
    2. A copy of the written estimate or quotation is to be signed and dated by the customer to indicate acceptance and should be returned to ROUNDBOX PRODUCTION.
    3. Alternatively, the client may send an official purchase order in reply to the estimate or quotation which binds the client to accept our terms and conditions, or an email acknowledging acceptance of the quotation.
    4. For the avoidance of doubt, the ROUNDBOX PRODUCTION Terms & Conditions are what govern the job, not any conditions on the customer’s purchase order.
    5. A non-refundable deposit is payable to secure the date of your Event/Shooting Session.
    6. In the Event/Shooting session that more than one client wishes to book our services on the same day, preference will go to the first client to make a deposit payment.
    7. The remaining balance must be cleared within 4 weeks after your event date.
    8. Rescheduled events/shooting session will only be accommodated if the new date does not conflict with an existing booking.
    9. ROUNDBOX PRODUCTION will be the exclusive event/commercial videographers and/or photographers. It is the clients’ responsibility to secure access to all areas for videography and/or photography.
    10. The Client assumes all responsibilities for obtaining any necessary permission, clearance permits, etc., which may be required for ROUNDBOX PRODUCTION to photograph/video each event/shooting session, public or private.
    11. The Client assumes all responsibility for obtaining and retaining permission for access to any requested camera positions and is solely responsible for the quality of the final production resulting from the use of, or inability to use, such camera positions.
    12. ROUNDBOX PRODUCTION will not be responsible for coverage lost due to access restrictions. It is the clients’ responsibility to inform ROUNDBOX PRODUCTION of all timings and locations for the event/shooting session day, if timings are changed it is the clients’ responsibility to inform ROUNDBOX PRODUCTION of updated timings. ROUNDBOX PRODUCTION WILL NOT be responsible for coverage lost due to timing changes.
    13. All creative aspects such as shooting and editing style are at the discretion of ROUNDBOX PRODUCTION, the client acknowledges that they are familiar with the Company’s portfolio and is requesting services with knowledge of the company’s style. Accordingly, client acknowledges that the photos or videos shall not be subject to rejection on the basis of taste or aesthetic criteria as they are familiar with the artistic style of ROUNDBOX PRODUCTION.
    14. The client has critically viewed samples of ROUNDBOX PRODUCTION videography and/or photography work and hereby grants full editorial and production control to ROUNDBOX PRODUCTION for all aspects of the production and post-production services for the event/shooting session.
    15. In the event a particular segment of the event is either not recorded, partially recorded, or not a part of the edited master tape, it is at the sole discretion of ROUNDBOX PRODUCTION as the exclusive producer of the events videography and /or photography.
    16. By supplying images, text, or any other data to ROUNDBOX PRODUCTION, the customer grants ROUNDBOX PRODUCTION permission to use this material freely in the pursuit of the photo/video.
    17. Should ROUNDBOX PRODUCTION, or the customer supply an image, text, audio clip or any other file for use in a website, multimedia presentation, print item, exhibition, advertisement or any other medium believing it to be copyright and royalty free, which subsequently emerges to have such copyright or royalty usage limitations, the customer will agree to allow ROUNDBOX PRODUCTION to remove and/or replace the file on the site.
    18. The customer agrees to fully indemnify and hold ROUNDBOX PRODUCTION free from harm in any and all claims resulting from the customer in not having obtained all the required copyright, and/or any other necessary permissions.
    19. Changes requested to the final video or photographs after delivery to client are charged at a rate of RM100 Per Hour with a minimum of 2 hours charged.
    20. The customer also agrees that ROUNDBOX PRODUCTION holds no responsibility for any amendments made by any third party, before or after a design is published.
    21. ROUNDBOX PRODUCTION WILL NOT be held liable for any production problems beyond our control, e.g. Bad weather, accidents, interference from guests etc.
    22. ROUNDBOX PRODUCTION reserves the right to terminate this contract at any time for any reasonable cause, e.g. accident or ill health, in this event all money will be refunded in full.
    23. Upon taking possession of the finished product, the client must inform ROUNDBOX PRODUCTION of any technical or other problems with their product within 7 days of receipt. After the 7 day period, if no notification has been received, the client will be deemed satisfied with the product.
    24. Photographer and Videographer retains the copyright to all images and video, can use any of these for promotional purpose except as agreed otherwise.
    25. The final output will be in JPEG format(for photos), MOV/MP4 format(for video); charges maybe apply if need specific format.
    1. The customer will be provided with a Proof Email, or an agreement prior to final publication. At this time the remainder of the amount due will become payable to ROUNDBOX PRODUCTION.
    2. All the footages shooting or project files will be deleted after 3 months
    3. Payments may be made by online transfer or bank cheque.
    4. Payments made by cheque must be previously agreed and may be subject to an administration charge. Cheques should not be sent in regular mail unless sent recorded delivery.
    5. Publication and/or release of work done by ROUNDBOX PRODUCTION on behalf of the client, may not take place before cleared funds have been received.
    6. Returned cheques will incur an additional fee of RM 200 per returned cheque. ROUNDBOX PRODUCTION reserves the right to consider an account to be in default in the event of a returned cheque.
    7. Customers whose accounts become default agree to pay all ROUNDBOX PRODUCTION ‘s reasonable legal and accounting expenses and third party collection agency fees in the enforcement of the debt and these Terms and Conditions.
    8. ROUNDBOX PRODUCTION WILL NOT be held responsible for any and all damages resulting from such claims.
    9. ROUNDBOX PRODUCTION is not responsible for any loss, or consequential loss, non-delivery of products or services, of whatever cause. The customer agrees not to hold ROUNDBOX PRODUCTION responsible for any such loss or damage.
    10. Any claim against ROUNDBOX PRODUCTION shall be limited to the relevant fee(s) paid by the customer.
    11. Any indication given by ROUNDBOX PRODUCTION of a project’s duration is to be considered by the customer to be an estimation. ROUNDBOX PRODUCTION cannot be held responsible for any project over-runs, whatever the cause. Estimated project duration should be deemed to be from the date that cleared funds are received by ROUNDBOX PRODUCTION for the initial payment or by date confirmed in writing by ROUNDBOX PRODUCTION.
    12. ROUNDBOX PRODUCTION considers the photo/video project complete upon receipt of the customer’s signed Approval form or signoff email. Other services such as printing, display panel production, graphic, website uploading, publishing etc either contracted on the client’s behalf constitute a separate project and can be treated as a separate charge.
    13. Goods sold are not refundable.
    14. All fees, services, documents, recommendations, and reports are confidential.
    15. All rights reserved, a rate 1.5% per month on all overdue accounts.
    16. Cancellation of orders may be made initially by telephone contact, or e-mail, however, following this, ROUNDBOX PRODUCTION will need formal notification in writing to the company’s postal address. The client will then be invoiced for all work completed over and above the non-refundable deposit that will have been made at the time of first ordering. The balance of monies due must be paid within 30 days.
    17. Please note: any cancellation which is not formally confirmed in writing and received by ROUNDBOX PRODUCTION within 14 days of such instruction being issued, will be liable for the full quoted cost of the project.
    18. Disclaimer – ROUNDBOX PRODUCTION makes no warranties of any kind, express or implied, for any and all products and/or services that it supplies. ROUNDBOX PRODUCTION will not be held responsible for any and all damages resulting from products and/or services it supplies. ROUNDBOX PRODUCTION is not responsible for any loss, or consequential loss of data, or non-delivery of products or services, of whatever cause. While we take reasonable steps to investigate the materials we recommend, we accept no responsibility for the performance or quality of materials or any consequential loss arising from their failure. The customer agrees not to hold ROUNDBOX PRODUCTION responsible for any such loss or damage. Any claim against ROUNDBOX PRODUCTION shall be limited to the relevant fee(s) paid by the customer.
    19. ROUNDBOX PRODUCTION reserves the right to use the services of sub-contractors, agents and suppliers and any work, content, services and usage is bound by their Terms and Conditions. ROUNDBOX PRODUCTION will not knowingly perform any actions to contravene these and the client also agrees to be so bound.
    20. These Terms and Conditions supersede any previous Terms and Conditions distributed in any form. ROUNDBOX PRODUCTION reserves the right to change any rates and any of the Terms and Conditions at any time and without prior notice.
    21. Acceptance of Terms and Conditions and Quotation – The placement of an order for design and/or any other services offered by ROUNDBOX PRODUCTION, by email, verbally or in writing, is deemed to be acceptance of these terms and conditions, which are freely available at www.roundboxmy.com
    22. An estimate validated by the customer’s signature on the estimate or quotation form, or by email, constitutes acceptance of the estimate or quotation and agreement to comply fully with all the Terms and Conditions and forms a Contract for Business between the signatory and ROUNDBOX PRODUCTION.
